An Antioch man allegedly told Oakland hotel staff he was drunk woman’s brother so he could rape her in his room. Now he faces kidnapping charges

OAKLAND — An Antioch man has been arrested and charged with kidnapping and raping a woman who reported waking up in an Oakland hotel room with no idea how she got there, police said.

Mackie McDuffy, 42, was charged with kidnapping and rape of an unconscious person and is being held without bail. He has pleaded not guilty and is next due in court on Sept. 24, records show.

The woman first reported the sexual assault in 2021, after she said she woke up in the room on Embarcadero partially nude, with some of her property missing. She said she’d been hanging out with a friend that night and gotten extremely drunk, police said in court records.

Investigators interviewed a hotel staffer who told them that a man had come into the hotel with the victim the night earlier, and used her credit card to pay for a room. The man had feigned concern for the victim and claimed to be her brother. The woman was vomiting, completely incoherent and appeared barely awake, the staffer allegedly told police.

McDuffy was identified as the suspect through a DNA match, according to police. He was arrested on Sept. 16 and booked into Santa Rita Jail.
